Federal Case Alleges Political Elite Get Favorable Tax Treatment Over Ordinary Citizens

Why is it that political insiders get a pass on their tax problems when ordinary citizens get criminally prosecuted?

- Tim Geithner, political insider: Back taxes owed, no prosecution

- Charles Rangel, political insider: Back taxes owed, no prosecution

- Tom Daschle, political insider:  Back taxes owed, no prosecution

- David Jacquot, ordinary citizen and retired Army Officer:  NO taxes owed, PROSECUTION?!?
 

On 5 March 2009 a Motion was filed in U.S. v. David Jacquot, Case # CR 08-1171, in the Federal District Court, in San Diego, California seeking to dismiss a false tax return indictment on the grounds that the Defendant was not treated in the same manner as politically prominent individuals.  A hearing on this matter is set for 30 March 2009 in San Diego and the Defendant in this case intends to subpoena Secretary of the Treasury Timothy Geithner, House Ways and Means Chairman Charles Rangel, former Senate Majority Leader Tom Daschle, and others.

     

The Defendant in this case is David Jacquot, an attorney and retired Army Officer.  He is a decorated disabled Desert Storm veteran living in rural Idaho with his family. 

This “Geithner Motion” cites HR 735 titled the “Rangel Rule Act of 2009,” which if enacted, would eliminate penalties and interest for common citizens to allow them to be treated in the same manner as House Ways and Means Chairman Representative Charles Rangel.  The Geithner Motion also quotes President Obama stressing the need to “treat common citizens in the same manner as politically prominent individuals in regards to tax matters”.

The Geithner Motion details how Mr. Jacquot was vindictively indicted in retaliation for his successful defense of his clients against the IRS.  The tax returns of his corporate law firm for the four (4) years of 2001 to 2004 were investigated and the government alleges that the law firm declared almost $200,000 TOO MUCH income during this time period.  The Geithner Motion contains descriptions of numerous actions by the government and Assistant U.S. Attorney (AUSA) Faith Devine that are the basis for the claim of retaliation against Mr. Jacquot for his zealous representation of his client’s Constitutional and statutory rights.  The improper actions of AUSA Devine have been reported to the DOJ Office of Professional Responsibility for disciplinary action and are currently under review.

    • Duff, now I know what I have thought all along. You are a cheerleader for the libs. Instead of applauding our fellow service member for going against the status quo, you rail him as a tax cheat himself. Thanks you though, maybe now it will be more clear to others as to what angle you write from.

      Please read the actual Court documents found on my website before jumping to conclusions.

      The Justice Department lawsuit you link to in your comment was thrown out of Court at the very first hearing and the government was required to pay attorney’s fees for bringing such a ridiculous case. The actual opinion of Judge Burns regarding the case you cite is on my website.

      You need to know the facts before you make slanderous allegations such as I am a professional tax cheat and I live in Idaho to duck prosecution. If you have evidence that I am a professional tax cheat, please produce it and please use your real name. Contrary to your opinion, the Federal government can and does prosecute people living in Idaho, so your allegation that living in Idaho allows you to duck prosecution is false.

  2. I don’t care whether he is a professional tax cheat or not. It sounds to me like all this story is asking for is for him to be treated like Geithner, Rangel and Daschle, all professional tax cheats themselves. It’s a sad day in America when we are chearing “regular” tax cheats in the name of fairness. If this isn’t enough to promote the fair tax or a flat tax, nothing is!

    I have a degree in Finance and can barely do my own taxes. By the way, I use Turbo Tax and Geithner was definately lying because TT clearly asks the question he said he missed. Either that or he’s just stupid. So we either have a liar or a stupid person in his key role. Makes one feel really good, doesn’t it?

  3. I really do not know anything about Mr. Jacquot. But if he is representing citizens against the IRS more power to him. Taxes are illegal even though we pay them. Part of the reason we fought the British and kicked there _ _ _ _ _ out of here. People need to speak out more than what they are saying now. It is a shame. I hope the real working class Americans will wakeup and see how it really is. The rich and the politicians get by with whatever but let a citizen try and he is arrested and prosecuted. So much for equality. And by the way I thought I heard the President say there were to be no more pay increases and bonuses for any company we the tax payers were bailing out. What about AIG. I say hang all of them in the public square!!!!

More, we proudly begged and received our bailout because our performance on the hill was superb! I’ve earned my BONUS for a job well done! And you? You the hard working Veteran, screw you!     This case is really not about me. It is about the rights that belong to all of us. No one knows better than veterans the cost of these freedoms. Whether you know me or like me is irrelevant.     I am a veteran of two years combat in Vietnam as an Air Force pilot. In 1968, I received my honorable discharge and have been denied employment in the United States for more than 40 years because I served in an “unpopular war.” I have, however, earned a doctoral degree in Europe and worked for many years as a research scientist in Germany and Brazil. Because I frequently faced overt discrimination in the United States, I have filed several lawsuits pro se. I have been successful in some, but in most of those I filed against the federal or a state government, my lawsuit has been improperly dismissed by the judge in deference to a U.S. attorney or a state attorney who the judge personally knew. I noted that every time one of my lawsuits is dismissed, the IRS audits my taxes a short time later. I have never had to pay anything because of the audits, and my taxable income for the years audited amounted to less than $3000 because of the employment discrimination of which I was complaining in the lawsuit. What is the connection between the Department of Justice and the IRS, which permits one to use the other for retaliation?
