Jailed Wisconsin Veteran Case Gets More Bizarre

What does the U.S. government do with a veteran who blows the whistle on the U.S. Dept. of Veterans Affairs (DVA) shreddergate scandal?
A Wisconsin veteran who badgered the DVA as he “tenaciously pursued his claim for disability benefits," telling DVA staff that they are a bunch of "bureaucratic assholes found out!
The Bush-Cheney DVA and the U.S. Dept. of Justice targeted, convicted, and impoverished this Wisconsin Navy veteran on trumped-up charges of wire fraud. Now this bizzare case has gone legally insane. But who cares about another veteran screwed for life? Not Steven Biskupic, former U.S. Attorney for the Eastern District of Wisconsin, and certainly not the DVA or the veterans’ court system.
Specifics, say the U.S. government, are that Navy Airman Keith Roberts and Gary Holland (who was crushed to death by a C-54 aircraft at an airbase in Naples, Italy, back in 1969) were not friends [despite their parallel service histories] and Roberts exaggerated his efforts to rescue his fellow airman, [despite the fact that he was on line duty, and subsequently at least one veteran present has corroborated Roberts' actions].
Yeah, that’s right, those are the specifics of the prosecution’s criminal case hatched back in 2005-2006 to shut up and retaliate against a veteran who had become, according to a Milwaukee DVA regional hospital source, a "belligerent ass." [A background source at the Clement J. Zablocki VA Medical Center in Milwaukee e-mailed the Lee Rayburn radio show in Madison in early June 2007 after a program about the Roberts case and asked to remain anonymous out of fear of losing his job. "I'd have to say that you guys are TOTALLY (uppercase in the original) right about Roberts' conviction being bullshit. ..." Disability claim denied and off to jail.
In the latest developments, Roberts, a political prisoner of the Republican Party, now reportedly embittered and feeling hopeless, is expected to be released from federal prison in March after serving almost four years behind bars.
He still has a rare case [Keith A. Roberts v. Eric K. Shinseki (05-2425)] pending before an en banc panel of the U.S. Court of Appeals for Veterans Claims (CAVC) that issued what appears to be a bizarre order on December 29, 2009.
Roberts and the DVA
Roberts was advised in 2002 by the late Jim Henning, a Shawano County (Wisconsin) Veteran’s Service Officer, to apply for an earlier retroactive date for his PTSD disability benefits predicated in part by his witnessing Holland being crushed to death and related trauma.
Bad move.
Critics and veteran groups rightly accused the Bush administration of the unprecedented politicalization of the Department of Justice and the DVA, and see the indictment and conviction of Roberts (and other veterans) on charges of wire fraud as a consequence of this politicalization that discourages Vietnam-era veterans from seeking PTSD benefits, per the views of the American Enterprise Institute‘s Dr. Sally Satel.
Roberts was diagnosed with PTSD and granted disability benefits in 1999, but became suspicious that the DVA was altering his Claim file (C-file), and he loudly accused the VA of engaging in fraud in phone conversations. Ultimately, the VA and then US Attorney Stephen Biskupic turned Roberts’ charge around, and charged and convicted Roberts with fraud, an injustice that still has veterans all over the country shaking their heads in disbelief.
U.S. Court of Appeals for Veterans Claims (CAVC)
Now, almost five years after Roberts’ case has been before CAVC, the Court is ordering litigants to product "memoranda of law addressing the meaning and applicability of 38 U.S.C. § 6103(d)(1) [a federal regulation]." The problem is that this case has absolutely nothing to do with this federal regulation that relates to a veteran’s residency of a particular state, nor has any party in this case ever raised the issue. Writes Judge Lawrence B. Hagel who dissented from the Court in an extraordinary written opinion on a Court order for litigants to produce memoranda of law (reproduced in full below):
Hagel, Judge, dissenting: It is not my practice to object to a request by fellow jurists to seek additional briefing in a case to enable them to make a more informed decision. The procedural history of this case, however, compels me to depart from this view, in which I strongly believe. Consequently, I register my strong objection to the issuance of this briefing order for the following reasons:
1. Mr. Roberts’s appeal was filed on August 26, 2005. This matter has now been before the Court for more than four years and four months. Briefing on this matter can serve no purpose but to further deprive, for no good reason, the parties of a decision in this matter. This is especially so in the light of the fact that neither party has raised the issues listed on the briefing order nor did the Court inquire about them in or in light of the numerous presentations to the Court, which include numerous supplemental briefings and two oral arguments.
2. The briefing order would have the parties discuss the applicability of 38 U.S.C. § 6103. Section 6103, on its face, does not apply to the facts of this case, as Mr. Roberts was "a resident of, or domiciled in, a State at the time the [fraudulent] act or acts occurred." 38 U.S.C. § 6103(d)(1). Accordingly, he is simply not subject to the forfeiture provisions of section 6103(a) and any briefing on the matter will surely be superfluous to the issues actually before the Court.
3. Neither party contends, nor has ever contended, that section 6103 has any relevance to Mr.Roberts’ appeal, and the issue has not been raised at any stage of these proceedings. The Court’s issuance of this briefing order invites the Secretary to once again change his position regarding the laws and regulations applicable to Mr. Roberts’ appeal.
4. Given that Mr. Roberts was not criminally convicted of fraud until more than a year after the Board decision in this case affirmed that VA’s severance of service connection was proper, I fail to see the relevance of the third question to be briefed regarding VA’s ability to initiate severance proceedings once a veteran has been convicted of fraud in a Federal criminal proceeding.
5. In light of the delay already endured by the parties and the fact that both have a right to appeal our decision, whatever it may be, it is time to stop wringing our hands and issue a decision in this case. My view of the insistence to issue this briefing order was expressed more succinctly by the noted social commentator Will Rogers when he observed, ‘Even if you are on the right track, you will get run over if you just sit there.’
For these reasons, I respectfully dissent from the Court’s issuance of this order.
On a personal note, I have reported on this case for years and I would hate to wager anything on a just ruling from any judicial body despite the Court of Appeals for the Seventh Circuit’s July 12, 2008 opinion reading in part: "The record might also have supported a jury determination that Mr. Roberts sincerely believed that his statements were true and that he had no intention to defraud the Government," written without consideration of any exculpatory evidence that has come forward since 2005.

But they called it a new claim just to back pay only to the new date, shorting me ovr two years of backpay. The problem is likely because, if I was told correctly,Bush-Cheney turned cost management of the VA over to Halliburton subsidiary KBR on a maged cost contract. Meaning that if they spend less than the budgetted amount by congress they pocket the difference. Dont know if that is true or nt, but if so EVERY VETERAN MUST CALL THER LAWMAKERS AND DEMAND THE END OF COST MANAGED CONTRACTS FOR VETERAN BENEFITS, AND TO THE BETTER TREATMENT OF VETERANS. As for draft deferment Cheney and AWOL Gone Wrong, they should move to Fallujah and see just how much the Iraqi’s love them because every veteran I meet hates them.
I can say here in Gainesville Florida they have done a great job and I have no complaints. I don’t want to get on the Bush – Cheeney deal and Politics. Look across the board— start in the 80′s and 90′s Bush was not president then and we got screwed real good with Agent Orange. Look at what happened in 91 with the VA again BUSH was not president. I got caught up the 90′s with the B.S. and again I will say Bush was not president! Need to take this Republican / Democrat fight some where else. In the era of Bush here in Florida we have more clinics and a new Hospital in Orlando. We have a new Veterans Home in Saint Augustine Fl. Bush pissed me of many times but I never experienced it at the VA and now they are working to right some wrongs on Agent Orange. Maybe it is that particular Hosp or as I see some Vets with an attitude. I saw one show his ass over having to wait 45 minutes for his prescription. Profanity made him look stupid and got him thrown out!

Being he was put in jail. did he not have acess to a Jury. This is the kind of case where trial by jury is a right. Did a jury rule in this case? I:f not why did he not demand a trial by Jury?

Yeah, he had a jury. So did Georgia Thompson, a woman the same US Atty went after, who was found guilty and declared innocent on appeal in a case that stands with the Don Siegelman case as among the worst persecutions of the Bush DOJ.
This is why we need a US Atty in a given district who realized the power of his office is such that he can convict innocents.

The best that anyone could conclude is that a civilized society wants violence for some demented reason. It is like violence is what is called for rather than talking and solving the conflicts. Some one posts Heather Hamel’s picture on Craig’s list and some one calling himself her husband threaten everyone. First the pictures are of a work nature published on WMUR-TV all the time. The pictures depict a beautiful woman that is a public figure. A woman doing her job in a profession, proud manner representing the station in a positive way is good. Personally at this moment I have a beef with the news media for their biased reporting. Not just WMUR but the newspaper and other types of media. They do not publish the people’s responses to what the media does to harm the public. The media awards themselves prizes based on what they think of themselves pushing biased news on the public. The facts cannot be changed but to hype them up a twist can be placed on them to intrigue their readers or listeners. One must tell both sides even if government figures are caught in wrongs. A person is innocent until proven guilty in a court of law as the saying goes. This is not true when it comes to the media. Swaying public opinion by high lightening the unacceptable can even if not related to the actual wrong is biased reporting. Judges allow prosecutors (when the states case is questionable) harm a defendant’s character to sway the jury. Judges are the most biased individuals that the legal monopoly protects because of the power of the club that they all belong too (the Bar Association). Hand in Hand the news and courts reflect just how our fore fathers knew how some day greed of power would involve the need to abolish these individuals. Hence a civilized society wants violence.
The public opinion was deemed necessary for our nation to survive, by our fore fathers. This according to the news is no longer a factor. If the public’s opinion does not say what the media wants it is changed or censored. Harm is placed on the character and life of a 100% disabled veteran and the news media can only report hype to harm the veteran. Government officials as NH Governor Lynch, Shea-Porter and others violate the Constitution to harm this U.S. Military disabled veteran and the media does not report it. The media is so biased that they refuse to allow a natural born U.S. Citizens to inform the public of these government wrongs by refusing to print the opinion letters delivered to each one daily. Judge Fauver violated the constitution (making Fauver a criminal) to intentionally harm a Madbury NH family. I volunteer my time to help this family and the courts and government tear my life apart. The media does not want the truth, hence the call for violence.
I have lived in the most violent world of the U.S. Marine Corps and you could not handle it. I write this letter because it is like Heather Hamel’s husband and the other side pushing until violence happens and both sides lose. I will not be violent because to make the U.S. better someone has to show the people talking can work. We just need to learn how to hear what the others are saying.

i agree with what i see and read here as i’m a former newhampshire resident and i seen this sort of things go on now for years. it is a shame how the media only reports what they want. how does our society allow such things. their is always two sides to every story. why is it that as stated here it says that violance is what the media wants. why? see i’m a totally disabled vietnam veteran who seen death up close. and many other things, its not a pretty sight or memmory.but for the media and the government it means big gains and popularity for them both.society does not look for a peaceful solution in todays world. its not the way as you say.many of my fellow veterans now and in the past have suffered due to the media and the government.
the governments will come up with anything and everything to sustantiate how they are right..they send us to war and train us to survive and become killers. then prosecute us for the very same things they trained us to do. i think we need to turn government upside down and inside out and shake it till all the bad apples fall out. but than if we do that, who will be left and who will the media use to carry out their propagander.i dare any media or washington official to go one on one with a 100% disabled veteran in a faceoff on live tv with no pre recordings and answer any and all questions. but first i would recommend security for the veteran as well as a bullet proof barrier and private escort unanounced and known by the federal government. of course the government official chosen will need none of what was mentioned.
The trial by jury is a most significant issue, yet before a person(s) can be charged they need to first be indicted by a Grand jury.
Was this man first properly indicted?
This key element in the protection of civil rights (The GRAND JURY PROCESS) is in large measure violated in many jurisdictions.
Merely by observing this most important rule, we will end the abuse of process that is carried by some agents on the public payroll.
It is in the 5th amendment to the constitution and was made the law of the land in 1791.
The WACO massacre did not follow legal procedure and a Grand jury never indicted the victims, before their home was invaded and they were mass murdered. The director of the BATF, that did the atrocities at Waco in on the payroll of the IMF, as is the state police director in Illinois. These person are agents of a foreign power, the central bankers who own and operate the war crimes cartel.
Governor Blagojevich was given similar treatment when agents of the war crimes cartel stuck a gun in his face at his home under cover of darkness, lacking probable cause that a crime had been committed.
The only party that can establish “Probable cause” that a crime has been committed is a Grand jury.
The cartel’s agents must figure that they got away with it at WACO, might as well do the same thing to the folks in Illinois.

Hello: What veterans need most are law schools for veterans law along with studies of the US Constitution. Veterans law is very complicated and as it has been said from the Courts for Veterans Appeals, that the only thing constant is change, in The Court and Veterans Law. Win a CUE 07-3399, point this out to the NSO’s and you will be berated as most of these people hate pure knowledge.
Knowledge is the key not politics as practiced by many veterans and their organizations.
In my opinion the Department of Veterans Affairs is a corrupt bureaucarcy.

Another related issue is that all veterans need to contact lawmakers to demand all civilian records be included in their medical file. And that VA doctors be certified and held accountable for malpractice. Because VA doctors fail to diagnose properly whether intentional or not. And since the doctors could be held accountable for malpractice they would not falsify records or fail to properly diagnose, treat and care for veterans. PICK UP YOUR PHONES MY FELLOW VETERANS. WE COULD BE THE MOST POWERFUL LOBBY IF DC IF YOU ALL WOULD STAND TOGETHER! DEMAND FIVE THINGS. ALSO KNOW THAT THE VA HIRES CIVILIAN FIRED DOCTORS, THAT MUST END!

Hitler once said in reply to trying the Germans who tried to blow him up in 1944 with a jury trial. “No jury trials. A well spoken person could do us allot of harm”.
The lawyer for the veteran. If he was worth his salt. He would have stood up before the jury and apoligized to the court and jury. On the grounds that the right for veterans to hire a lawyer was only approved last year. The Veterans court has only been around sincve 1990 and they are all over the map as far as what is law and what is not.
However our forfthers gave us the right not to be repersented by lawyers for the simpel fact back in those days lawyers sold out there clients. Veterans really do need to go to law librarys to study veterans law and how to defend themselfs in a court room.
For rears I have commented on my own results of telling the VA when they stole my VA check from me. I warned them I would for the purpous of haveing my own day in court with a real judge, jury, and lawyer. I would walk in on a jury trial in progress and surrender to it for my own safety from the VA. 4 days latter that check was in my mail box. The VA is affraid of well spoken veterans who are willing to represent themselfs in a court of law if pushed to far. Why are we killing ourselfs when we could use our lives for one last stand in a court room which would help other veterans and force the government to give the vet the care they were being deproved from in the first place.
The Court-appt lawyer at trial was, to be candid, outgunned by the US Atty’s office.
At trial, the US Atty slandered Roberts (which you can do in court), made material misrepresentations about VA claim adjudication procedures (such as they exist), and on and on. The VA hated this guy and went right after him during the years when Bush-Cheney believed they could do anything.
You could receive the Medal of Honor and if targeted by the gov: You become shit.
Here we go again with the court system. I to am a veteran and trying to get my benefits. I do realize to takes time and we ask to wait but the goverment did not wait for us, you go know or go to jail. I also have a real problem with our justice system, and here are (2) stores the first one was about a man driving at a high rate in a 45 mph area lost control ran in to a house and killed a man while he was watching tv, the drive you may say walked away with no crimanl justice. Look in the Greenville News Greenville, SC and you can find this story. Here is another one my was abused in a local hospital after beging taken there by ambulance for a possible heart attack, was physical abusedby the nurse in self defense my wife hit the nurse and the nurse filled charges a after that my wife was sent to jail for 30 days ,30 days house arrest and 2 years probation, keep one thing in mind she is disable.

I did see the 60mn VA segment. I have seen these stories come out once every 5 to 10 years and nothing in between. Veterans see this storie and feel finnely somethiing will happen. Nothing never does become of it. If 60mn stories had any impact. There would not be this storie saying the same thing but in a differnt time. Congress might hold hearings and show public fake outrage. However if you really want to know whats going on Read Gilbert v. Derwinski CVC ruling. There the judges noted that congress ordered the VA to write veterans denials to be as vauge as posibel. This order was so veterans could not win there appeal with any sucess.
Unless veterans want to get there benifits. They must change there approch to the VA.

Now that the Bush DOJ is gone, there is less pressure to attack veterans is this way. Just ignoring veterans for seems to be the strategy.
Isn’t this the same VA that is held up as a model for government agencies being able to handle universa; health care?
There are 2 VA’s the VBA is Veterans Benefits Administration where all of the claims are handled (Keith Roberts compensation claim and VA OIG) and then there is the VHA Veterans Health Care Administration which provides the nations veterans with medical care, clinics, hospitals, doctors and nurses etc that is what is being held up as a success, no one is holding up the VBA as a model of anything but riddled with problems and it does not have anything to do with “health care”
Myself I give the VHA an A+ for my healthcare since 1997
I gove the VBA a F+ they excell at screwing up most claims
There are people who bear no burden nor pain from war but are only made richer by it.
Until these people suffer, why would anything change?
My hope is that those who are offing themselves would, instead, go after those whose demise might change The Way Things Are.

The editors do not want the U.S. citizens to hear the truth. Some U.S. Military veterans get great care and those are the ones that the editors publicly display all over the news. No one wants to talk about the loser homeless person dying on the street that just happens to be a U.S. Military veteran having trouble adjusting back here in the world. (The World) is the way that the U.S. Military in Vietnam talked about the United States back home? The ones that we loved and the country we hoped to live long enough to see again. The World was what we started our day thinking about and ended what ever happen during those long 13 months with the dream of coming home. We come home to a world that no longer can understand or accept the demented miss actions or words that now are our norm. Instinct of survival and security evades the mind even in the safe confines of the world (US) decades later. Our loved ones and society around us believe time should resolve any lingering reminders of what it was like. Talk and social interaction should quite the delusional episodes of what we did so that you would not have too. The U.S. citizens not hearing the truth because of censorship evades what we did it for.
The U.S. Military Veterans responses are too graphic and mulish for the editors to print our words to what they tell the readers. The news no longer cares about the truth or the opinion of its readers unless it supports the media’s position. The U.S. Public is denied what it is like but the U.S. Military veteran lives through it every day until we die. It is not that the public cannot handle the truth; it is censorship is imposed to protect you from it. I write letters every day and people ask me why the newspapers do not print them. My letters contain the truth of what so many of you need to know but will not because some one believes it is not right for you to be informed of it. I am one of those unstable veterans with multiple disabilities that society is protected from. I am the U.S. Marine from Maine that killed his wife in NC as the effects (of there) came here. I am that gentle father that you live with hiding his life (there) to protect you (here). I am the child brain washed to kill others with out emotion as long as it fit the criteria of legal engagement. I am the U.S. Military that did things so unacceptable back here (that became a norm) that they must stay silently in my sub-conscious or become the thorn that allows the editors view to justify censorship. You do not want to know what we became. You want to believe that we are the children that could have been what you wanted leaving that U.S. Military Veteran alone in a place that just would not leave him.
When the U.S. government is allowed to use the health care of U.S. Military veterans, as a political tool there can be no truth. 60 minutes did a story on disabled veterans being denied care. This will be the end to helping those in need as the U.S. Military Veteran’s description tells just why you censor our responses.
DELAY, DENY AND HOPE THAT WE DIE just says that suicide is the only option. Can this be emotion wanting to protect the U.S. Public from people like me or is dying the only way to end the truth that you do not want to hear.

Chief Joseph of the Nez Perce Indians said “From where the sun now stands, I will fight no more forever”. I didnt realize at the time why he would say these words and it came to me…..” It does no good to make a treaty or pac with men who are not honorable to their words”. He was talking about the government in general at the time. So I ask you “Whats changed”? Will a show of force by a million veterans banding together on Washington make a difference? The reason’s why they can divide and conquer is because of ourselves. We have so many service organizations, VA, congress, senate and state legislatures that are supposed to be their representing our veterans that have only looked to benefit themselves. A suggestion might be to just let it go, dont enlist, quit the military, convince our son’s and daughters, fathers and mothers that ” From where the sun now stands, I will fight no more forever”. Let the Government, Corporate America fight its own battles. Peaceful resistance can be a way to fight the lawless injustices of America.
