Victims of the “Feres Doctrine” Part 2, Chapter 3 – Vietnam Veteran sent to War with a Broken Neck

 During Rusty’s one-month hospitalization at Camp Drake Army Hospital in Japan Rusty said he was Awarded The Purple Heart and proudly displays his Purple Heart License Plates on his vehicle.

 After being discharged from Camp Drake, Rusty was flown to Vandenberg AFB in Southern California and placed into a medical holding clinic for two days.  After that Rusty was flown to Balboa Navy Hospital in San Diego where he stayed for two weeks.  Then Rusty was sent to Fort Ord where stayed for 6-months, pending his discharge which was placed on hold.

MILITARY DISOBEDIENCE FUNNIER THAN THE MOVIE “MASH”

During his 6-month stay at Fort Ord Rusty still refusing to wear a uniform and refusing to sign documents presented to him that would discharge him under less than honorable conditions, Rusty said he advised the Army that he would not sign any documents unless they included a medical discharge with service-connected disability under honorable conditions. 

During this period at Fort Ord, Rusty said that he spent most of his nights sleeping in his Dodge Van off- post and just coming back to his barracks to check his mail for discharge paperwork.  Rusty said the Army really did not know what to do with him and his disobedient behavior and the fact that they were getting all kinds of letters from Members of Congress for them to act favorably on behalf of Rusty, so the Army pretty much left Rusty alone while the Army played the “waiting game” to see if Rusty would given-in under their terms.

Finally, on November 19, 1970, Rusty said the Army gave-in and presented him with discharge papers for medical discharge with a 10% disability rating.  But on this same day the games played by the Army with Rusty would not end.  But as you will see, Rusty played a better game than the Army did.

Rusty said the Officer in charge of his discharge papers told him that before he would sign his paperwork that Rusty would have to get a haircut and bring him a receipt from the Post Barber shop, and that Rusty would also have go have be wearing a military uniform.  Keep in mind that Rusty had refused to wear a uniform since March of 1970, and had not had a haircut for at least six months.

So Rusty went to the barber shop and paid the barber $2.00 and asked him for a receipt for a haircut but would not let the barber cut his hair. 

After the barber shop Rusty went to the base uniform distribution center where new recruits were getting their first uniforms and stood in line until his turn and then told the clerk to give him his uniform.  The clerk not knowing what to make of Rusty’s appearance threw the uniform at Rusty.  But Rusty threw it back at him and told the clerk to hand it to him with respect and not like he was a piece of garbage.  And so the clerk handed the uniform back to Rusty.

Rusty then got his paperwork signed in reverse chronological order by going to the General’s Office first and then working his way back to said lower-echelon Officer in charge of his discharge paperwork.  When Rusty arrived at said Officer’s office, Rusty brought him the barber shop receipt for the haircut and then laid the uniform issued to him on the Officers desk but refused to wear it.  Rusty said this Officer then gave-in and signed the remaining paperwork and Rusty departed in his Van.

Finally, Rusty was medically separated from Military Service where he has lived a life of pain.  However, Rusty has directed much of his pain by becoming a Veterans Rights Advocate fighting to keep the Benefits Veterans already have, as well as lobbying for new Veterans Benefits.     To loose the focus of the real crime, sending men and women to War with critical injuries or sending men and women back into War when they cannot defend themselves is the real crime here and the proof is on the table. The Officers in charge should all be in prison and the FERES Doctrine should be abolished today.
    To focus on the purple heart award instead of the real story here “FERES Doctrine Abuses” tells me a lot about who wrote the comments at the end of this horrific story of being sent to War with a Broken Neck.
    FERES Doctrine is the Cancer inside military hospitals and VA hospitals. How can Congress say that we are FREE when we have no rights to protect ourselves with the U.S. Constitution from redress of gross criminal negligence caused by the abuses of federal employees is the real story here. In my case the enemy fire is FERES Doctrine which allows Officers to murder those in critical care. When a Company Commander ignores human rights its all because FERES Doctrine protects Officers in charge from radical crimes like this and Congress looks the other way. No wonder why the moral is so low inside the military and suicides are off the rector scale. The very same rights that we all risked life and limb for and so many died for we do not have while we dawn the uniform. No men or women who are in the U.S. Military should have to sacrifice their Constitutional Rights to defend this Country of Ours!
