The Prosecution of George W. Bush for Murder
The Legal Framework for the Prosecution
By Vincent Bugliosi
“That the king can do no wrong is a necessary and fundamental principle of the English constitution.”
—Sir William Blackstone, Commentaries on the Laws of England, 1765“No living Homo sapiens is above the law.”
—(Notwithstanding our good friends and legal ancestors across the water, this is a fact that requires no citation.)
With respect to the positionI take about the crimes of George Bush, I want to state at the outset that my motivation is not political. Although I’ve been a longtime Democrat (primarily because, unless there is some very compelling reason to be otherwise, I am always for “the little guy”), my political orientation is not rigid. For instance, I supported John McCain’s run for the presidency in 2000.
More to the point, whether I’m giving a final summation to the jury or writing one of my true crime books, credibility has always meant everything to me. Therefore, my only master and my only mistress are the facts and objectivity. I have no others. This is why I can give you, thereader, a 100 percent guarantee that if a Democratic president had done what Bush did, I would be writing the same, identical piece you are about to read.
Perhaps the most amazing thing to me about the belief of many that George Bush lied to the American public in starting his war with Iraq is that the liberal columnists who have accused him of doing this merely make this point, and then go on to the next paragraph in their columns.
Only very infrequently does a columnist add that because of it Bush should be impeached. If the charges are true, of course Bush should have been impeached, convicted, and removed from office. That’s almost too self-evident to state. But he deserves much more than impeachment. I mean, in America, we apparently impeach presidents for having consensual sex outside of marriage and trying to cover it up. If we impeach presidents for that, then if the president takes the country to war on a lie where thousands of American soldiers die horrible, violent deaths and over 100,000 innocent Iraqi civilians, including women and children, even babies are killed, the punishment obviously has to be much, much more severe.
That’s just common sense. If Bush were impeached, convicted in the Senate, and removed from office, he’d still be a free man, still be able to wake up in the morning with his cup of coffee and freshly squeezed orange juice and read the morning paper, still travel widely and lead a life of privilege, still belong to his country club and get standing ovations whenever he chose to speak to the Republican faithful. This, for being responsible for over 100,000 horrible deaths?* For anyone interested in true justice, impeachment alone would be a joke for what Bush did.
Let’s look at the way some of the leading liberal lights (and, of course, the rest of the entire nation with the exception of those few recommending impeachment) have treated the issue of punishment for Bush’s cardinal sins. New York Times columnist Paul Krugman wrote about “the false selling of the Iraq War. We were railroaded into an unnecessary war.” Fine, I agree. Now what? Krugman just goes on to the next paragraph. But if Bush falsely railroaded the nation into a war where over 100,000 people died, including 4,000 American soldiers, how can you go on to the next paragraph as if you had been writing that Bush spent the weekend at Camp David with his wife? For doing what Krugman believes Bush did, doesn’t Bush have to be punished commensurately in some way? Are there no consequences for committing a crime of colossal proportions?
About the book
In The Prosecution of George W. Bush for Murder, Bugliosi presents a tight, meticulously researched legal case that puts George W. Bush on trial in an American courtroom for the murder of nearly 4,000 American soldiers fighting the war in Iraq. Bugliosi sets forth the legal architecture and incontrovertible evidence that President Bush took this nation to war in Iraq under false pretenses—a war that has not only caused the deaths of American soldiers but also over 100,000 innocent Iraqi men, women, and children; cost the United States over one trillion dollars thus far with no end in sight; and alienated many American allies in the Western world.
As a prosecutor who is dedicated to seeking justice, Bugliosi, in his inimitable style, delivers a non-partisan argument, free from party lines and instead based upon hard facts and pure objectivity.
A searing indictment of the President and his administration, The Prosecution of George W. Bush for Murder also outlines a legally credible pathway to holding our highest government officials accountable for their actions, thereby creating a framework for future occupants of the oval office.
Vincent Bugliosi calls for the United States of America to return to the great nation it once was and can be again. He believes the first step to achieving this goal is to bring those responsible for the war in Iraq to justice. Visit Official Vincent Bugliosi Web Site

If the Country doesn’t seek ‘Accountability’ well there should never be heard again “Why do they hate us so?” for the World already knows and has suffered from the Blowback already and will for the coming decades!!
There’s another well used saying, “We shall never forget!” Guess who else won’t “Forget!!!”!!
Jim, your respect and empathy for your fellow man is noted and remarkable.
For me, until George W. Bush is prosecuted for murder, then my belief in the USA as the land of the free and home of the brave ceases to exist. As it stands, it’s just another country and is no longer the land of democracy and rule of law so long as it’s leaders get away with murder. And for those on the GOP side, that goes for all it’s future leaders including .. donkeys and independents…all of us.
Now there are heroes ie.. Vincent Bugliosi who stand up but will America stand up together? I hope so because we need a great USA….. In my view, George W. Bush must be prosecuted to save the USA, to save the world…. if not, I will forever fear the USA as future Presidents will have the Bush green light to go!
Hey there Mr Bugliosi in case you haven’t noticed both parties share an equal blame for the US going into Iraq along with the CIA and NSA.
Since when is the Democratic Party for the so called “little guy”!!!!???
Neither one of these parties are for the “little guy”. They are in it for themselves in case you haven’t noticed!!
Wake up and smell some ammonia or get off they stuff you been smoke’n!!
Matt, I do agree with you on the “neither party” holds a candle for the little guy. No matter, by reputation, the GOP is well noted as the party of “business” and the “little guy” Bugliosi refers to is probably the “blue collar working guy” which Dems have a past reputation for supporting. That’s clearly Bugliosi right to stand behind a long standing ideal even though it’s clear that leaders are beholden to their investors and, we the people, are marginal fodder for their ambitions.
Nevertheless, your comment does NOT address the issue on what George W. Bush did and the reasons why ALL AMERICANS need to get behind this; that is if we are going to save our integrity, our democracy, our ideals…..without this prosecution, we be unable to recapture our once esteemed position and will continue to wallow in the mediocrity of contempt; just a bully on the street with no friends. Is that what our future holds?
Johnn, why not go all the way back to the Vietnam War and start with the same politicians and their cronies who got us in that trumped up war?
Do you see my point? Both parties were responsible for us being there also.
Their is an always will be enough blame to pass along for both of these parties who play head games with the American people once they get in office.
The Road To Hell Is Paved With Good Intentions no matter how good their intentions/lies are(if their any left among these thieves and pirates).
For purposes of this article, the discussion centers on whether or not we are going to prosecute crimes against humanity or not? It’s that simple. This is NOT a Donkey versus Elephant issue at all. It’s an American ideals issues? Who are we and what do we stand for?
As it relates to Vietnam War and all subsequent wars following, President Dwight D. Eisenhower warned of the Military Industrial Complex and so here we are.. Are we at the apex of this or do we have more to go? Unmitigated, average men like Obama have the proverbial gun to their head and no amount of integrity can save them from looking down the barrel of this global elite force. We need a revolution and need to drag the criminals to justice now. We start with Bush and work our way UP!
We agree to disagree.
But on the matter of music I just sent you an email via your website.
You can reply to me via my email address.
Of course both parties are responsible and will be as long as both parties have so many members with their hand extended to the largess of special interest that want war some for profit some for power. Close the Congress door to those lobbies, enforce the rules that a government official cannot accept money or gift from special interest an if they do they cannot participate or vote on or promote any issue involving their patrons. Write the A.G. and demand bribery law be enforced, I did, and he did on one Senate Committee’s members. The issue was already researched by the IRS a bribery is “something for something” including “influence” on decisions.
Ross Perot was on the right track when he told us sending new people to a pollute and infected Congress that makes and enforces its own rules will incapacitate the new comer “we have to clean out the Barn”
To demand law be enforced is our right and no new legislation an debates are necessary when the laws is already on the book. As for Bush to me he represent the the power of the lobbies to intimidate and black mail up to the highest office. So, why not drag out Lucifer from his/her comfortable viper’s pit and do what God did. Remember what God did to Lucifer, now called Satan? And I am an Agnostic but it is a simple clear example of what needs to be done, as Perot stated.
Both parties are guilty.
funny how the same people don’t want all the other presidents to pay for their crimes-The Kennedys didn’t have to pay for their murders or the Clintons for that matter-why should Bush? what about 9/11.what about all the lies every politician has told us from birth, religion, extra marital affairs? we’ve never made them accountable before.Get over Bush and lets get our nation back under control and remind Washington they work for us-not the other way around
Thank you Lee! This article post was utterly nonsense, made up to help the flailing Dems in November.
I’m all for making a buck, but if you don’t have any facts to back up your claims, then you must classify your book as fiction.
Facts? Forgive me Jeremiah but have you been sequestered since 2000?
The facts are there Jeremiah, conviction within the rules of law is a different story. I’m all for prosecution and imprisonment of Misters bush, cheney, rumsfeld, wolfowitz, and a host of others, but it probably just won’t ever happen. Not with the Democratic Party preventing it for their own political purposes.
Sadly, imprisonment will never bring my son back. He and so many others KIA in Iraq were sacrificed for the egos of the forementioned chicken hawk bastards. Most days, I merely strive to live longer than dubbya. Maybe my only satisfaction will be to take a dump on his grave.
Sir, I am beyond words to describe my feelings of loss for your family; it makes me furious especially under the circumstances of which your son passed. We will get Bush and save our country so that your son and all the rest we’ve lost on all sides can rest in peace knowing that justice was done. And we will send a message to Obama and all the rest that follow that MURDER IS A CRIME and as President, you are just a man. And for any of those who are paying for these murders; namely the global elite, well we’re coming for ya!
JEREMIAH ! WHAT FACTS YOU ARE TALKING ABOUT ? THE HUNDREDS OF VIDEOS AVAILABLE SHOWING BUSH AND HIS CRONIES ANNOUNCING THEY HAD THE PROOF THAT IRAQ HAD WEAPON OF MASS DESTRUCTIONS,WHILE PUBLISHING A MAP OF IRAQ SHOWING ALL THE LOCATIONS ,
THE VIDEOS SHOWING BUSH WARNING US ABOUT THE MUSHROOM CLOUD OVER AMERICA,
AND STATING “MISSION ACCOMPLISHED” 5 YEARS AGO, AND THAT WE WILL CATCH BIN LADEN WHEREVER HE IS AND THEN TWO YEARS LATER STATING THAT HE WAS NOT REALLY INTERESTED TO GET HIM….IT IS AVAILABLE ON YOU-TUBE JEREMIAH, ARE YOU LIVING ON MARS?
I AM WONDERING IF JEREMIAH IS A BLIND DEATH MUTE…TONS OF DECLASSIFIED DOCUMENTS ARE AVAILABLE JUST GOOGLE ANYTHING ABOUT IRAQ WAR OR AFGHANISTAN AND YOU’LL FIND PAGES BACKING UP EVERYTHING WRITTEN IN THIS ARTICLE WHICH BRING ABSOLUTELY NOTHING NEW ABOUT THE BUSH ADMINISTRATION…WE ALL KNOW… THIS ARTICLE IS JUST A REMINDER OF VERY WELL ESTABLISHED FACTS…I WOULD LIKE JEREMIAH TO PROVIDE US WITH THE DOCUMENTS SHOWING THAT IN FACT GEORGE W BUSH WAS RIGHT, THERE WAS INDEED WMD’S IN IRAQ AND THAT THE 5000 YOUNG AMERICAN MEN WHO DIED LOOKING FOR THEM INDEED DIED FOR A GOOD CAUSE : THE TRUTH ! NOT TO MENTION THE 1.3 MILLION IRAQI CIVILIAN WHO GOT KILLED IN THE PROCESS ONLY 10% WERE INSURGENTS ACCORDING TO OUR DEFENSE DEPARTMENT THE REST WERE “COLLATERAL DAMAGE” MEN WOMEN AND CHILDREN
WHO WERE AT THE WRONG PLACE AT THE WRONG TIME..
I would not give Blackstone’s Commentaries a second thought. The Ukanian homeland is itself divided on this one. Sir William reflects only the English view. The Declaration of Arbroath in 1320, which may have contributed to the American constitutional principles, expressed the sovereign authority of the people and made it plain to the then King Robert the Bruce that if did not abide by and champion the will of the people, in those days against the English, he would simply be replaced. The words of the Elder Kingdom in the British arrangement thus pre-date Blackstone by 445 years. Absolutely NO-ONE is above the law in the Ancient Kingdom of Scotland. [That principle allowed the Royal German Immigrant to be sued for re-setting the stolen property known as the Stone of Destiny in 1994-7, resulting in its return to Scotland].
Bush should be much easier, and please drag Blair in, and down, with him!
Have fun!
I do NOT doubt the sincerity of Blair and Bush as it relates to their decisions and ambitions. I am sure they believe to this day that what they did was right and they would be in a esteemed notorious company including but not limited to Adolf Hitler, Josef Stalin, Augosto Pinochet, and Slobodan Milosevic; to name just a few in their league! Hey, if it smells like a crime against humanity, guess what?
Instead of writing books about it and flogging them… why doesn’t someone get on with prosecuting him….?
Great Question! Why doesn’t Obama take action? Very strange! What is going on behind the scenes?
If you get any insights… let us know….
Gee…I wonder what Tom Tancredo thinks about this??! He’s anxious to impeach President Barack Obama, but does he stand on the same “principles” re: Dubya and his band of merry bushitters?? Or is Tancredo just standing up for the double standard that his kind usually applies to black folks??! In the past Tancredo has supported all that the bushitters did, and in fact, carried their toilet paper. I’m not really questioning…I’m just reminding.–JB
Tancredo’s position is without integrity. Just another politician with an agenda
How one can still relate, or support either DC party totally dumbfounds me as both know the inside 9/11 story or, at least, must be aware of the real evidence, inconsistancies and have done nothing about i.e criminal complicity.
I do nor acknowledge or support any present ‘representative’ party or gvnt.
Their hands all are bloody & tainted.
We need a totally disinfected the house to offer a future for this country.
They all stink. Well, almost all.
DAMN YOU “GUFF” LEAVE MY COMMENTS ALONE !!!!!.
WHY DON’T YOU GUYS FIGHT THE GOVERNMENT TO ARREST OBAMA NO# 1 MURDEROUS AND TERRORIST DURING WAR IN KENYA AND MANY TOHERS OBAMA PLANNED TO KILL 200,000,000 AMERICANS FOR SAKE OF BILDERBNERGS !!. DAMN YOU THINK ABOUT OBAMA MUST BE HANG RIGHT NOW , WHERE ARE YOUR’S US MILITARY ARE REALLY COWARD TO GET OBAMA INTO JAIL, YOU GUYS HAVE EASY TIME TO ARREST BUSH INSTEAD OF OBAMA ! YOU GUYS ARE SICKO !!!!
Your lack of holding G.W. Bush accountable speaks of bias. It’s not a credible position. A crime is a crime no matter who commits the crime.
(We will get Bush and save our country:)—— Bullshit, it will not happen. Never has and never will in this day. The post has set up a lot of thoughts. I see this post about Bush as no more than a big ad for the book. It’s called special interest IMO. This is not the first time this has happened, nor do I think it will be the last. MONEY-MONEY FOR YOUR HONEY My thoughts, SEEVIEW
Of course Bush and crew should be prosecuted for treason, war crimes, 9/11 etc. etc. We could make lists of others to join him in prison or at the gallows all day long.
But … Bugliosi is nothing but an opportunist and disinformation agent. Remember his massive book on the JFK assassination. He concluded lone nut Oswald did it and acted alone. A ridiculous continuation of the cover up.

Bugliosi is all about making money, creating limited hangouts and diverting our attention away from those behind the creation of puppets like Bush and Obama.
All of us who have seen it know there is no such thing as a clean war and innocents will always get caught in the crossfire. That is why when a country goes to war, the whole country must go to war. Bush and his neo-cons privatized war and made war for corporate interests (Naomi Klien explains it well in her book “The Shock Doctrine”) War is the most serious decision a country can make.
I agree: Bush, Chaney and the other neo cons need to pay for their crimes against humanity and against the US Constitution and the people. It will never happen.
What its all about is that George Bush LIED and so did Colan Powell and Dick Cheney about Iraq and the weapons of mass destruction. which never were any. if their were any they were moved along time ago to Syria. now thw reason this war was started is because of the vast oil fields in the middle east. all over the middle east and oil piple lines that run to the CASPIN SEA. Billions of Dollars were made off these wars. and continue. both republicans and democrats have blood on there hands. they both are responsible for the shit they caused. the world trade center was all planed by both parties along with our corrupt pentagon. planes in the air in New York corridor and no military aircraft to get them out of their. plus NORAD in Colorado did nothing. Cheney saw to that. ISRAEL is also behind this false wars. Israel controls our Congress and Senate. all republicans kiss Israel’s ass. the worst one is trader Joe Liberman and John McCain and jack crap Linsey Graham. they would love ot get America involved in another war with IRAN. do Israels dirty work. Brack O’Bama should cut all ties to Israel and also all foreign aid . foreign aid that goes to kill inocent people. Israel is going to cut her throat if she bombs Iran. also we may get into a NUCLEAR WAR. with these dum asses. now ALL THE INVOLVED IN the two worthless wars should get tried for TREASON AND WAR CRIMES. THERE IS NO PLACE THEY CAN HIDE. the HAGUE TRAIL OR CONVENTION will i hope some day get these bastards.
all republicans kiss Israel’s ass. the worst one is trader Joe Liberman and John McCain and jack crap Linsey Graham.
The above statement is slamming every Republican. You have rubber stamped all in the GOP. Why, because you hate them? What about the ones that have done a good job. So the next time you speak of the GOP, you could say most all of them. I’m not sticking up for any one party, but just shows that some minds type w/o thinking clearly. Thanks for reading. SEEVIEW
(Seeview) a look at your email statement. JUST WHAT REPUBLICANS DO YOU TALK ABOUT??? the ones that approved george bush war on a country that had nothing to do with 911. INVASION WITH OUT JUST CAUSE. BOY WHAT A REAL BUMMER. over 100,000 Thousand IRAQ’S died with the american invasion. this is criminal, and all the worthless politicans went along with it. GENOCIDE ON A COUNTRY that did not possess weapons of mass destruction. The United States put SADDAM HUSIN in power and then screwed his ass so to speak. LIES LED TO A GREAT DISSERVICE TO AMERICA and our military. i hope all politicans ROT IN HELL, WERE THEY BELONG.
