Federal Prosecutors Indict American Flag

LOS ANGELES – As though it is not un-American enough that the Department of Veterans Affairs (VA) has officially declared that our American Flag is a “placard, pamphlet, handbill or flyer” and further orders VA police to issue criminal arrest citations to Veterans and Patriots who display our Nation’s Colors outside the VA, but four deputy U.S. attorneys of the Department of Justice (DOJ) officially indicted the revered Flag of the United States of America, accusing It of being an imposter.

On February 3, the American Flag was arraigned and indicted in U.S. Federal Court for the Central District of California, Courtroom 341, Citation Case #4161140, “United States of America v. Robert L. Rosebrock,” after I pleaded “not guilty” to the VA’s criminal charges of “distributing of materials such as pamphlets, handbills, and/or flyers, and the displaying of placards or posting of materials on bulletin boards or elsewhere on property is prohibited.”

In sum, the American Flag — as we know It – is a co-defendant in this case because the DOJ cannot indict one without indicting the other.

And it still remains unanswered as to what authority VA Secretary Robert A. McDonald officially transformed our American Flag into a “placard, pamphlet, handbill or flyer?

On October 25, 2015, I displayed the American Flag on the front fence outside the VA, was criminally cited and my American Flag confiscated and held as “evidence” for being a placard, pamphlet, handbill, and/or flyer.”

A small child knows the difference between “Old Glory” and a placard and would seriously admonish VA Secretary McDonald and condemn him for falsely and unpatriotically declaring that the American Flag is not our Nation’s Symbol of Freedom and Justice.

And a small child could easily indict and prosecute the VA and DOJ for anti-Americanism, discrimination, retaliation, corruption, misconduct, malfeasance, etc.

The foregoing notwithstanding, Wednesday was clearly one of the proudest days of my life as I stood before U.S. Magistrate Judge Gail J. Standish to defend not me, but our Grand Flag of the Republic of the United States of America.

It was also a day that was clearly one of the most shameful in American history when “Old Glory” was maliciously prosecuted by four deputy U.S. attorneys and ceremoniously accused of being a fake and a fraud.

At the arraignment, I informed Judge Standish that my co-defendant, the American Flag, was present in the Court Room standing next to her. Correspondingly, I advised the Judge that America’s emblem of “Liberty and Justice for all” was improperly displayed to her left instead of to her right.

There is a disgraceful consistency of flagrant disrespect for the American Flag by our Federal Government as the VA continuously flies torn and tattered U.S. Flags on Los Angeles VA property where Veterans are trying to heal from war injuries they suffered while defending our Nation’s Colors, and these same VA bureaucrats criminalize the displaying of the American Flag outside the VA – calling it a placard – and they do this with the full support of the DOJ and U.S. Attorneys.

Sharon McCaslin, the lead U.S. deputy attorney at the arraignment, informed Judge Standish that even though I am pleading not guilty, the Court could fine me up to $5,000 and six months in jail if I’m found guilty. The Judge asked me if I understood the charges and conditions.

I respectfully responded that I was being charged with displaying placards, pamphlets, etc., and that I was in Court defending the American Flag, and as a Veteran, I was highly insulted by the VA’s falsified charges and that I had no problem with serving time in jail for defending the Honor of our American Flag.

Judge Standish said that she understood my concerns, declaring that she is also a Veteran, but again asked if I understood the results if found guilty, and I stated, “Yes.”

Incredulously, instead of immediately dismissing the bogus charges, Judge Standish allowed the sham DOJ indictment to go forward for Federal Trial, which is May 5, 2016.

It is a predicated fact that the Attorney General, U.S. District and Magistrate Judges, U.S. Attorneys, the Secretary of the VA, entrusted police officers, detectives and bureaucrats of the VA, etc., are all Federal employees.

Correspondingly, it is an established fact that co-defendants American Flag and Rosebrock are facing a stacked deck and a premeditated retaliatory, hostile, and malicious prosecution.

Nevertheless, it was an extremely proud day to stand on my own in the U.S. Federal Court, without legal counsel, defending the revered Flag of the United States of America. It doesn’t get any better than this.

And for the record, it is not the so-called “Constitutional attorneys,” Federal Judges, Supreme Court Justices, etc. who “defend” our United States Constitution. No, they merely try to enforce the U.S. Constitution in the safe and secure confines of Federal Courthouses.

On the contrary, it is the Men and Women of our United States Armed Forces who physically and selflessly “Defend” our U.S. Constitution against all enemies, foreign and domestic.

In fact, all Members of our U.S. Military pledge their lives to Defend our U.S. Constitution, and our American Flag is the official, International symbol of this noble and unparalleled Document of our Republic.

On February 17, Ted Hayes, “Mr. Patriot,” will appear in U.S. Federal Court to be arraigned for the same falsified criminal charges of displaying a placard or disbursing pamphlets, handbills and/or flyers in his case, “United States of America v. Theodore Hayes.”

Ted will be arraigned for displaying what was heretofore known as the original “13-Star American Flag” that has been sacrilegiously transitioned into a “placard” by VA Secretary Robert A. McDonald, a Graduate of the United States Military Academy at West Point, NY.

On February 17, I will also be arraigned for three more of the same counterfeit charges, as well as awaiting arraignment for two additional illegal arrest citations for proudly displaying the American Flag in honor of the Men and Women who have bravely and courageously defended our Nation’s Colors.

Ted’s and my plea will be the same “Not guilty.”

Fellow Americans, let us not forget that while Ted and I remain free until our forthcoming Federal Court Trials, there are 12 of our American Flags that are falsely imprisoned under lock and key in an “evidence storage room” at the Los Angles VA police headquarters.

If VA Secretary McDonald doesn’t respect our American Flag, what makes anyone think he respects the Men and Women who have defended It?

He doesn’t!

It is paramount and mandatory that our co-defendant, the Grand Fl.ag of the United States of America, be immediately released on Its own recognizance, along with a major public apology to our Nation’s Colors by President Barack Obama — and the prompt firing of VA Secretary Robert A. McDonald and his co-conspirators — as well as the same for Attorney General Loretta Lynch and her co-conspirators.
