Mr. President: Stop VA Police Brutality Against Elderly Veterans

Dear Mr. President.

You have some very serious problems with your Secretary of the VA, Robert A. McDonald, and the retaliatory, violent misconduct carried out under the color of law by Los Angeles VA police officers against elderly Veterans through the Secretary’s lawless and imperious orders.

I’m a 74-year old Veteran who was spared the brunt of the battle during the Vietnam War, but now fear for my own life on American soil at the hands of an out-of-control federal police force at the Greater Los Angeles VA (GLAVA), under Mr. McDonald’s dictatorial command.

For more than eight years, the Old Veterans Guard (OVG) has held peaceful, non-violent Sunday Rallies outside the GLAVA protesting the biggest land-fraud swindle in American history compounded by inhumane treatment of war-injured and impoverished Veterans who are forced to live homeless and hungry at skid row and in back-alley squalor because land that was deeded exclusively in their behalf has been pillaged and plundered for non-Veteran use instead of providing permanent supportive housing as specifically mandated in the 1887 Act of Congress and the Charitable Trust Deed of 1888.

Contrary to being a safe National Home for disabled, destitute and disadvantaged Veterans, the GLAVA is the most corrupt VA in the nation and it has grown more corrupt and criminal under your Administration, particularly at the unlawful directives of your current Secretary of the VA.

As a result of the OVG’s no-nonsense and loyal dedication to protect this land as it was deeded, we were instrumental in initiating a lawsuit that resulted in obtaining a Federal Judgment against the VA for misappropriating Veterans property to benefit non-Veteran entities.

Nine VA real estate deals were adjudicated in federal court as “unauthorized by law and therefore void.”

This land is clearly the most valuable on the West coast, if not the nation, and estimated to have a multi-billion dollar value.

The land is dissected by the 405 Freeway, one of the busiest expressways in the world, and Wilshire Boulevard, one of the busiest inner-city boulevards in America.

Moreover, these nearly 400 acres are surrounded by some of the wealthiest and most powerful ZIP codes in the USA.

Thus, Veterans premiere property meets the three standards for determining top real estate value: Location, Location, Location.

To underscore how valuable this land really is, more than a decade ago in 2006, developer Donald Trump bid $110,000,000 for a two-acre parcel in nearby Century City. He was outbid by $200,000 for land that sold for more than $55 million per acre.

The adjudged illegal occupants on Veterans sacred and sovereign property include powerful UCLA with it’s 10-acre state-of-the-art collegiate baseball diamond and paying a pitiful $500 per-acre, per-month for VA land valued at a half-billion dollars; the wealthy and private Brentwood School’s state-of-the-art athletic compound pays pennies on the market-value for VA land estimated to be worth nearly a billion-dollars; an affluent and influential neighboring homeowner group operating under the ruse of Veterans Park Conservancy pays zero rent for its proposed public park on VA land valued at more than a billion dollars, etc.

Instead of honoring the Federal Judgment and evicting these wealthy, powerful and illegal squatters that forced Los Angeles to be our nation’s capital for homeless Veterans, Secretary McDonald, a Defendant in the lawsuit, met privately and secretly with two of his wealthy and powerful personal friends, Bobby Shriver and Ron Olson – both are attorneys and neither are Veterans – and together they fraudulently manipulated a “settlement agreement” to vacate the Judgment based on their falsified promises, including ending Veteran homelessness in Los Angeles by the end of 2015.

Nineteen months later and Los Angeles remains our nation’s capital for homeless Veterans and the illegal occupants are more entrenched and protected than ever, awaiting the passing of a fraudulent bill co-authored by U.S. Senator Dianne Feinstein and U.S. Representative Ted Lieu that will make these illegal real estate deals “legal,” under the guise of “the Los Angeles Homeless Veterans Leasing Act of 2016”.

The only time the words “homeless Veteran” are mentioned in this bogus bill are in the title. This is an illegal leasing act that will make the Veterans Home a public sports, entertainment and amusement center.

There’s already an Act of Congress dated March 2, 1887 – CHAP. 316 – An act to provide for the location and erection of a branch home for disabled volunteer soldiers west of the Rocky Mountains, and it coincides with the subsequent Deed of 1888 to “locate, establish, construct, and permanently maintain a branch of said National Home for Disabled Volunteer Soldiers.”

Instead of honoring the Act and Deed, Los Angeles is our nation’s capital for homeless Veterans and this sacred and priceless land is frittered away for a pittance.

To reinforce the Act and Deed, the Mission of the OVG is to “Save Our Veterans Land” and to “Bring Our Homeless Veterans HOME.”

Accordingly, we have continued a loyal and vigilant protest against this land-fraud scandal of Biblical proportion.

The OVG also exposed the City of Los Angeles’s illegal occupation on twelve acres of Veterans land valued at more than a half-billion dollars — rent-free — that is used for a public dog park and recreational facility while war-injured Veterans are forced to live homeless and hungry on the dangerous streets of Los Angeles.

Subsequently, the GLAVA bureaucrats under the direction of Secretary McDonald, have maliciously retaliated against the OVG by sending armed federal police outside the VA during our Sunday Rallies to intervene and issue illegal criminal arrest citations when we display the American Flag in honor of the men and women who have defended our Nation’s Colors for more than two centuries.

The VA police declare they are just “following orders” as they unpatriotically and falsely cite us for “displaying a placard, hand bill, pamphlets, and / or a flyer without permission.”

Mr. President, you are a Constitutional lawyer with a degree from Harvard Law School.

You know that the First Amendment of the United States Constitution officially grants us permission (the right) to display the American Flag during our Sunday assembly and the Fourth Amendment officially protects our private property from illegal seizure by the government.

Correspondingly, we’ve already gotten 18 of those bogus placard citations “Dismissed / Acquitted” in Federal Court without legal counsel.

We’re not fools defending ourselves. No, we proudly defended the American Flag and rightfully won.

The U.S. Attorneys could not possibly prosecute us for displaying a placard without first prosecuting the American Flag for being a placard.

And that was not going to happen because standing next to all Judges in every courtroom across the USA is the American Flag, not a placard.

A small child knows the difference between the American Flag and a placard, but your Secretary of the VA who is a graduate of West Point and served as a Captain in the U.S. Army, does not.

Robert A. McDonald is a national disgrace and a shameful traitor who makes Benedict Arnold look like an American patriot.

Mr. McDonald, who is a member of your entrusted Cabinet, was angered and provoked by the VA’s humiliating defeat in federal court.

Instead of accepting this legal thrashing and leaving us alone, his bloated ego goads him on with resentful retaliation that has now expanded even more against the OVG by illegally sending VA police outside the GLAVA to illegally seize our cameras and to illegally and intentionally inflict police brutality by falsely handcuffing elderly Veterans and issuing more illegal criminal arrest citations … this time for “taking photographs without permission.”

On August 17, I appeared in federal court for a hearing arraignment regarding one of these new bogus citations — “Taking Video Recording Photographs Without Permission” — falsely issued by VA police officer Sgt. Michael Perez (Badge #2140).

Naturally, I pleaded “Not Guilty” to this counterfeit arrest and the Honorable Chief Magistrate Judge Suzanne H. Segal set a trial date for December 1, 2016.

Sgt. Perez used excessive force when illegally handcuffing me for a crime that I never committed. I was legally photographing another police officer who had illegally handcuffed and falsely arrested Mr. Patriot for displaying the American Flag, and we were on a public forum at the front entrance to the Los Angeles National Veterans Park.

Sgt. Perez illegally confiscated my camera because he is ashamed of his illegal activity and does not want his photo to be published on “Veterans Today” and other forms of public media. He continues to violate his federal oath of office to support and defend the U.S. Constitution.

On Sunday, August 21, just as we’ve done in the past, I proudly displayed an American Flag on the front fence of the National Veterans Park during our Sunday Rally.

Within minutes, and like “a thief in the night,” the same Sgt. Perez who issued the falsified photograph citation, illegally seized my camera and illegally handcuffed and roughed me up, sped recklessly across the Grand Lawn in a VA police vehicle toward where my American Flag was displayed.

The armed Sgt. Perez was visibly angry as he abruptly parked his VA police SUV inside the VA public park next to my American Flag, then aggressively jumped out and illegally seized (stole) my Flag, wadded it up like a dirty towel, got back into his VA police vehicle and recklessly sped away across the Grand Lawn.

I called the VA police dispatcher and stated that I wanted to file a citizen’s arrest against Mr. Perez for speeding and reckless driving on the VA’s Grand Lawn and the illegal seizure (theft) of my American Flag.

The dispatcher just laughed and rudely dismissed me saying he wasn’t going to file anything against Sgt. Perez.

I then displayed two small American Flags on the public park fence and within a few minutes a VA police squad car was seen a short distance away inside the VA, stalking and then sped away.

Shortly thereafter, Sgt. Perez drove his VA police SUV outside the GLAVA onto Wilshire Boulevard. He was obviously outside of his VA jurisdiction.

Clearly, he was stalking, harassing and intimidating me where I was publicly protesting on the LA County sidewalk.

Sgt. Perez got stuck in traffic just a few feet from where I was standing on the public sidewalk. He then illegally crossed two solid white lines on Wilshire Boulevard and recklessly sped away onto San Vicente Boulevard. All of this is directly adjacent to where we hold our Sunday Rallies on the Los Angeles County sidewalk.

Upon witnessing firsthand Mr. Perez’s aggressive and reckless misconduct, I immediately feared for my life because he was armed, has previously roughed me up physically while I was illegally handcuffed, compounded by his displayed anger and aggression in taking down my American Flag. Now, he was driving irresponsibly outside the VA in a large government vehicle only a few feet from where I was standing.

While our Sunday Rallies are normally for three hours, I made the prudent decision to disband after less than 40 minutes this past Sunday – our 440th consecutive Sunday Rally — and thereupon removed my two small American Flags, gathered our demonstration posters and safely departed while I could.

Mr. President, your appointed Secretary of the VA has instilled a corrupt culture of dishonesty, hate, violence, fear and lawlessness through the Los Angeles VA police that is perpetrated against those of us who legally protest against the biggest land-fraud scandal in American history while demanding the civilized and humane housing and care for our war-injured and impoverished homeless Veterans.

As a result, the VA police who operate under the propaganda of “Protecting Those Who Served” are maliciously persecuting a selected few elderly Veterans and they are inciting fear and a dangerous threat to our safety and well being.

Tragically, elderly Veterans of the OVG and citizen supporters will not attend our free speech Sunday Rallies in fear of the VA police’s out-of-control retaliation, brutal assaults and illegal arrests as it has escalated to even illegally threatening to arrest us for “trespassing” on the designated public forum.

Mr. President, this is Communism, not Americanism.

There’s an old adage in criminal investigation – “As time goes on, the clean get cleaner and the dirty get dirtier.”

Mr. President, your Department of Veterans Affairs is filthy dirty and it’s getting dirtier.

We have repeatedly notified and forewarned the VA Secretary, his GLAVA executive director, her chief of police, the Department of Justice, U.S. Attorneys, etc., to stop this ongoing violence, mayhem and lawlessness and it just gets worse – dirtier.

Mr. President, you have been bcc’d in our formal complaints sent via e-mail to public government officials within your Administration calling for the halt of this illegal activity and the resignation or firing of your VA Secretary.

You have remained silent.

War-injured and impoverished U.S. Military Veterans who pledged their lives to defend the American Flag remain homeless and hungry while VA police continue with their unlawful, brutal and criminal misconduct on elderly Veterans by declaring the American Flag is a placard and issuing false arrest citations coupled with excessive force and illegal handcuffing for taking photos of this illegal police activity.

Mr. President, this is to respectfully request that you either immediately fire Robert A. McDonald or order him to cease and desist from the unlawful denial of our rights with his retaliatory illegal criminal arrest citations being ordered through VA police … “under the color of law.”

18 U.S.C. §242 provides that; whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States … shall be fined under this title or imprisoned not more than one year, or both.

18 U.S.C. §245 provides that; whoever, whether or not acting under color of law, intimidates or interferes with any person from participating in or enjoying any benefit, service, privilege, program, facility, or activity provided or administered by the United States; [or] applying for or enjoying employment, or any perquisite thereof, by any agency of the United States; shall be fined under this title, or imprisoned not more than one year, or both.

Mr. President, you have some very serious problems with your Secretary of the VA, Robert A. McDonald, and the retaliatory, violent misconduct carried out under the color of law by Los Angeles VA police officers against elderly Veterans through the Secretary’s lawless and imperious orders.

In sum, Mr. President, clean up the dirt and take out the trash at the Los Angeles VA.

Lastly, why is there such hatred against the American Flag and such violence perpetrated against innocent elderly Veterans under your Administration?
